Lou,

It was good to see you Saturday night at the Real Estate Association of New Mexico’s annual dinner.

I was reviewing the documents that you provide on your web site and did not find what I was looking for. I spoke with the Real Estate Association of New Mexico’s attorney while in Albuquerque about what grounds a Broker has to withdraw a listing from a seller that they currently have an Exclusive Right To Sell (Listing Agreement) with. Ashley said that the Brokler does not have the right to withdraw simply because of dissatisfaction. In reviewing the Listing Agreement I see no grounds or section giving the Broker this opportunity. When a seller is “difficult” and the Broker no longer wants to work with that seller what verbage from the listing agreement does the Broker use for that or do we simply create our own addendum to the listing agreement.
